Terms of Use

Welcome to frontiertech.edu, the website and online service of Frontier Institute of Technology. This page explains the terms by which you may use our online and/or mobile services, website, and software provided on or in connection with the service (collectively the “Service”). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement (“Agreement”) and to the collection, use, and disclosure of your personally identifiable information as set forth in the Frontier Privacy Policy, whether or not you are a registered user of our Service.

 

We reserve the right to amend this Agreement at any time.. For material changes, we will provide at least thirty (30) days’ advance notice by email or through the Service before they take effect, and you may reject those changes by ceasing use and closing your account before the effective date. Non-substantive changes may be made without notice. Your continued use of the Service after the effective date of a material change constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Service. This Agreement applies to all visitors, users, and others who access the Service (“Users”).

  • Who we are
    1. Frontier Technology Institution LLC, d/b/a Frontier Institute of Technology (“Frontier”, “FIT”, “we”, “our”, or “us”) is an educational institution headquartered in Wyoming, United States of America.
    2. Frontier Academic Programs are accredited by the Distance Education Accrediting Commission (DEAC), an accrediting agency recognized by the U.S. Department of Education and the Council for Higher Education Accreditation (CHEA). Global Skills Academy (GSA) courses are non-credit professional courses and are not accredited. Accreditation of the Degree Programs does not extend to GSA courses, and completion of a GSA course does not confer academic credit.
    3. Frontier is approved by the Wyoming Department of Education under Wyo. Stat. §§21-2-401 et seq. 
    4. Frontier provides educational programs, professional development courses, certifications, academic support services, learning management systems, learner communities, and related educational services through its digital platforms and institutional operations.
    5. Frontier has two main offerings as part of the Services:
      1. Global Skills Academy (“GSA”) – The Global Skills Academy offers non-credit, professional courses designed for individuals seeking to acquire industry-relevant knowledge and skills outside of a formal academic credential pathway. GSA courses do not confer academic credit, degrees, diplomas, or other accredited academic qualifications unless explicitly stated. Courses or programs offered by GSA are not accredited. 
      2. Degree Programs (“Degree Programs”) – Frontier’s Degree Programs are accredited academic offerings designed for learners pursuing a formal academic qualification. Degree Programs are delivered in accordance with applicable accreditation standards, academic policies, regulatory requirements, and institutional quality assurance processes.
    6. Frontier acts as the controller of personal data collected through its websites, learning platforms, student information systems (SIS), support systems, and related services.
  • Use of our Service
    1. Our Service allows you to access our content and courses and interact with our faculty and other learners and Members via our adaptive online learning platform.
  • Eligibility
    1. This Service is intended solely for Users who are fifteen (15) years of age or older, and any registration, use, or access to the Service by anyone under fifteen (15) years or age is strictly prohibited and in violation of this Agreement.
    2. If you are under eighteen (18) years of age but at least fifteen (15) years of age you may use the Service only if you either are an emancipated minor or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement, and to abide by and comply with this Agreement. 
    3. If you are a parent or guardian subscribing to the Service for the benefit of your child, please be aware that you are fully responsible for his or her use and conduct on the Service, including financial charges and legal liability that he or she may incur. The Service is not available to any Users previously removed from the Service by Frontier.
  • Parental Consent (for minor users)
    1. I certify that I am over the age of 18 and the parent or legal guardian of the child that I am registering to use the Service.
    2. I agree that Frontier may use the information it collects during registration and from performance data directly from my child’s performance on learning activities, assessments, or otherwise to help Frontier formulate and manage my child’s learning path. 
    3. Additionally, I agree that this data can be used, in an anonymous aggregated form. 
    4. I understand that Frontier is not obligated to provide service to all and may limit its membership at its sole discretion for its commercial purposes. Frontier will not use a user’s registration, performance, or education data to deliver targeted advertising.
  • Terms of User Agreement 
    1. Be sure to carefully read and understand all of the rights and restrictions described in this Agreement and the Privacy Policy. 
    2. Potential users are asked to review and either accept or not accept the terms of the Agreement and the applicable Privacy Policy.
    3. Users cannot subscribe to or use the Service without accepting the terms of this Agreement and our Privacy Policy.
    4. The checking of the “Complete Sign-up” box at registration means you accept the terms of this Agreement and any documents which are referenced herein. 
    5. In case of minors, this Agreement is a legal agreement between you on behalf of yourself and the minors to whom you grant usage privileges and Frontier. 
    6. In case of parents / legal guardians, by checking the “Complete Sign-up” box, you are consenting to;
      1. Frontier’s use of the registration information to set-up your children’s logins and learning paths, 
      2. the collection and use of your child’s performance data to manage their learning path as described in this Agreement, 
      3. this Agreement and any documents referenced therein; and 
      4. the terms and conditions of use and payment for the Service described in this Agreement.
  • Frontier Institute Accounts
    1. Your Frontier account gives you access to the services and functionality that we may establish and maintain from time to time and at our sole discretion. 
    2. We may maintain different types of accounts for different types of Users.
    3. By connecting to Frontier with a third-party service, such as Facebook, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.
    4. You may never use another User’s account without permission. 
    5. When creating your account, you must provide accurate and complete information.
    6. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.  We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account. 
    7. You must notify Frontier immediately of any breach of security or unauthorized use of your account. Frontier will not be liable for any losses caused by any unauthorized use of your account.
    8. You may control your User profile and how you interact with the Service by changing the settings in your Settings page. 
    9. By providing Frontier your email address you consent to using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. 
    10. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. 
    11. If you do not want to receive such email messages, you may opt-out or change your preferences in your Settings page. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.
  • Prohibited Use Rules
    1. You agree not to engage in any of the following prohibited activities: 
      1. copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated “scraping”;
      2. using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Service in a manner that sends more request messages to the Frontier servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (except that Frontier grants the operators of public search engines revocable permission to use spiders to copy materials from www.frontiertech.edu for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials); 
      3. transmitting spam, chain letters, or other unsolicited email; 
      4. attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service; 
      5. taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; 
      6. uploading invalid data, viruses, worms, or other software agents through the Service; 
      7. collecting or harvesting any personally identifiable information, including account names, from the Service;
      8. using the Service for any commercial solicitation purposes; 
      9. impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; 
      10. interfering with the proper working of the Service; 
      11. accessing any content on the Service through any technology or means other than those provided or authorized by the Service; or 
      12. bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.
    2. Accessing the audiovisual content available on the Service for any purpose or in any manner other than Streaming (as defined below) is expressly prohibited. “Streaming” means a contemporaneous digital transmission of an audiovisual work via the Internet from the Frontier Service to a User’s device in such a manner that the data is intended for real-time viewing and not intended to be copied, stored, permanently downloaded, or redistributed by the User.
    3. We may, without prior notice, change the Service; stop providing the Service or features of the Service, to you or to users generally; or create usage limits for the Service. 
    4. We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if in our sole determination you violate any provision of this Agreement, or for no reason. 
    5. Upon termination for any reason or no reason, you continue to be bound by this Agreement. 
    6. You are solely responsible for your interactions with other Frontier Users. 
    7. We reserve the right, but have no obligation, to monitor disputes between you and other Users. 
    8. Frontier shall have no liability for your interactions with other Users, or for any User’s action or inaction.

 

  • User Content
    1. Some areas of the Service allow Users to post content such as profile information, comments, questions, and other content or information (any such materials a User submits, posts, displays, or otherwise makes available on the Service “User Content”). You retain ownership of your User Content.
    2. You agree not to post User Content that: 
      1. may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal; 
      2. may create a risk of any other loss or damage to any person or property;
      3. seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;
      4. may constitute or contribute to a crime or tort;
      5. contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable; 
      6. contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party’s trade secrets); 
      7. contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or
      8. contains any information or content that you know is not correct and current or 
      9. violates any school or other applicable policy, including those related to cheating or ethics. 
    3. You agree that any User Content that you post does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights (as defined below) or rights of privacy.
    4. To the extent that your User Content contains music, you hereby represent that you are the owner of all the copyright rights, including without limitation the performance, mechanical, and sound recordings rights, with respect to each and every musical composition (including lyrics) and sound recording contained in such User Content and, have the power to grant the license granted below.
    5.  Frontier reserves the right but is not obligated, to reject and/or remove any User Content that Frontier believes, in its sole discretion, violates these provisions. You understand that publishing your User Content on the Service is not a substitute for registering it with the U.S. Copyright Office, the Writer’s Guild of America, or any other rights organization.
    6. For the purposes of this Agreement, “Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights, and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals, and extensions thereof, under the laws of any state, country, territory or other jurisdiction.
    7. In connection with your User Content, you affirm, represent, and warrant the following:
      1. You have the written consent of each and every identifiable natural person in the User Content to use such person’s name or likeness in the manner contemplated by the Service and this Agreement, and each such person has released you from any liability that may arise in relation to such use.
      2. Your User Content and Frontier’s use thereof as contemplated by this Agreement and the Service will not violate any law or infringe any rights of any third party, including but not limited to any Intellectual Property Rights and privacy rights.
      3. Frontier may exercise the rights to your User Content granted under this Agreement without liability for payment of any guild fees, residuals, payments, fees, or royalties payable under any collective bargaining agreement or otherwise.
      4. To the best of your knowledge, all your User Content and other information that you provide to us is truthful and accurate.
    8. Frontier takes no responsibility and assumes no liability for any User Content that you or any other User or third party posts or sends over the Service. 
    9. You shall be solely responsible for your User Content and the consequences of posting or publishing it, and you agree that we are only acting as a passive conduit for your online distribution and publication of your User Content. 
    10. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose, and you agree that Frontier shall not be liable for any damages you allege to incur as a result of User Content.
  • Intellectual Property, Copyright, Trademarks & User Content
    1. Frontier Intellectual Property
      1. All rights reserved.
      2. All course materials, curricula, assessments, videos, presentations, learning resources, software, graphics, trademarks, logos, and other proprietary content made available through Frontier programs, websites, learning platforms, or services (“Frontier Content”) are protected by applicable copyright, trademark, and intellectual property laws.
      3. Frontier Content is owned by Frontier Institute of Technology or its licensors.
      4. Except as expressly permitted by Frontier, users may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publish, sell, license, or otherwise exploit Frontier Content.
  1. Limited License to Use Frontier Services
    1. Subject to compliance with Frontier policies and enrollment requirements, Frontier grants users a limited, non-exclusive, non-transferable, revocable license to access and use Frontier services and Frontier Content solely for personal educational purposes.
    2. No ownership rights are transferred through access to Frontier services.
  1. User Content and Academic Work
    1. Users retain ownership of original assignments, projects, submissions, discussion posts, portfolios, and other content they create and submit through Frontier programs (“User Content”).
    2. By submitting User Content, users grant Frontier and our affiliates  a limited, non-exclusive worldwide, transferable and sublicensable, royalty-free license, without any further consent, to:
      1. receive, use, store, modify, reproduce, distribute, publish and process the content;
      2. evaluate coursework and academic performance;
      3. verify academic integrity;
      4. conduct accreditation, audit, and quality assurance activities;
      5. maintain academic records;
      6. comply with legal and regulatory obligations; and
      7. improve educational delivery and student support services.
    3. This license continues only for as long as reasonably necessary to fulfill these educational, institutional, legal, and record-retention purposes.
    4. Frontier does not acquire ownership of User Content through this license.
  1. Feedback and Suggestions
    1. Users may voluntarily provide suggestions, recommendations, comments, or ideas regarding Frontier services.
    2. By submitting such feedback, users acknowledge that Frontier may use, implement, modify, and incorporate the feedback without compensation or obligation to the user.
  1. Trademarks
    1. Frontier names, logos, service marks, branding elements, and related marks are the property of Frontier Institute of Technology or their respective owners.
    2. The CHEA logo is a registered trademark of the Council for Higher Education Accreditation and is used in accordance with applicable permissions and guidelines.
    3. Nothing in Frontier services grants any license or right to use Frontier trademarks without prior written authorization.
  1. Copyright infringement and DMCA
    1. Frontier respects the intellectual property rights of others and expects users to do the same.
    2. If you believe copyrighted material has been used in a manner that constitutes infringement, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA). Frontier will review and respond to valid notices as required by applicable law.
    3. Frontier respects intellectual property rights and complies with the Digital Millennium Copyright Act of 1998 (“DMCA”). Frontier will respond to properly formatted notices of alleged copyright infringement submitted to its designated copyright agent.
    4. If you believe your copyrighted work has been infringed through the Service, you must provide a written notice including:
      1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner
      2. Identification of the copyrighted work claimed to have been infringed
      3. Identification of the material claimed to be infringing and its location on the Service
      4. Contact information (address, telephone number, and email)
      5. A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law
      6. A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner

  1. Frontier may terminate accounts of users who are deemed repeat infringers and may also restrict or terminate access to the Service for any user who infringes intellectual property rights, at Frontier’s sole discretion.
  • Paid Services
    1. Billing Policies
      1. Certain aspects of the Service may be provided for a fee. If you choose to use paid features, you agree to the pricing and payment terms in effect at the time of purchase, as updated from time to time at Frontier’s discretion.
      2. Frontier may introduce new services or modify existing services, including fees and charges, at any time in its sole discretion.
      3. If you purchase services through a third-party payment processor or a third-party platform (e.g., Facebook), you agree to that platform’s payment terms. Frontier is not a party to those transactions.
    2. Cancellation and Refund
      1. All cancellations, withdrawals, and refunds are subject to the applicable Frontier refund policy for the specific program, course, certification, or educational service purchased which is incorporated into this Agreement by reference and discloses the applicable refund schedule and any pro-rata terms. Where any fee renews automatically, Frontier will, before each charge, (a) present the renewal price, frequency, and cancellation method clearly and conspicuously, (b) obtain your affirmative consent to those automatic-renewal terms, and (c) provide a cancellation method at least as simple as the method of enrollment.
    3. Payment information and Taxes
      1. All information provided in connection with any purchase must be accurate, complete, and up to date.
      2. You are responsible for all charges incurred using your payment method, including applicable taxes, based on the pricing in effect at the time the charges are incurred.
      3. You agree to pay all applicable taxes, fees, or government charges associated with your use of the Service.
  • Academic Policy
    1. Learners enrolled in academic programs, Degree Programs, diploma programs, certificate programs, or other credential-bearing offerings may be subject to additional institutional policies, including but not limited to Academic Integrity, Academic Progress, Grading, Attendance, Appeals, Credit Transfer, Graduation Requirements, and Student Conduct policies. In case of any inconsistencies between this Agreement and such policies, the latter will take precedence.
    2. By enrolling in such programs, Users agree to comply with all applicable institutional policies published by Frontier Institute of Technology and updated from time to time.
    3. To the extent a user is enrolled in a Degree Program and Frontier is an educational institution subject to the Family Educational Rights and Privacy Act (FERPA), Frontier maintains “education records” in accordance with 20 U.S.C. §1232g and 34 C.F.R. Part 99. 
    4. GSA courses are non-credit and non-accredited. Credits, certificates, or completions from GSA courses are not guaranteed to transfer to, or be recognized by, any other institution, employer, or licensing body. Learners seeking transferable academic credit should enroll in a Degree Program  
  • Privacy Policy
    1. We care about the privacy of our Users. We collect, use, and share both personally identifiable information and non-personally identifiable information as described in our Privacy Policy.
    2. By using the Services, you acknowledge and agree that your information will be collected, used, transferred to, and processed in accordance with the Privacy Policy, including processing in the United States.
    3. Frontier uses commercially reasonable physical, managerial, and technical safeguards to help preserve the integrity and security of your personal information and to implement your profile settings. However, no method of transmission or storage is completely secure, and we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or misuse your information.
  • Third Party links
    1. The Service may contain links to third-party websites, advertisers, services, offers, or other content that are not owned or controlled by Frontier.
    2. Frontier does not endorse and is not responsible for any third-party websites, services, content, or materials. Accessing third-party sites is at your own risk.
    3. Your use of third-party websites or services is governed by their own terms and privacy policies, not by this Agreement or Frontier’s Privacy Policy.
    4. Frontier is not responsible for any transactions, interactions, or disputes between you and third parties, including advertisers, even if accessed through the Service. Any dealings, including payments, delivery of goods or services, warranties, or representations, are solely between you and the third party.
    5. Frontier shall not be liable for any loss or damage arising from your use of or reliance on third-party websites or services.
  • Indemnity
    1. You agree to defend, indemnify and hold harmless Frontier and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from:
      1. your use of and access to the Service, including any data or content transmitted or received by you; 
      2. your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above; 
      3. your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; 
      4. your violation of any applicable law, rule or regulation; 
      5. any claim or damages that arise as a result of any of your User Content or any that is submitted via your account; or 
      6. any other party’s access and use of the Service with your unique username, password or other appropriate security code.
  • No Warranty
    1. The service is provided on an “As is” and “As available” basis.
    2. Use of the service is at your own risk. To the maximum extent permitted by applicable law, the service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 
    3. Without limiting the foregoing, Frontier, its subsidiaries, and its licensors do not warrant that the content is accurate, reliable, or correct; that the service will meet your requirements; that the service will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected, or that the service is free of viruses or other harmful components. 
    4. Frontier does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the frontier institute service or any hyperlinked website or service, and frontier institute will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.
  • Limitation of Liability
    1. To the maximum extent permitted by applicable law, in no event shall Frontier, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, that result from the use of, or inability to use, this service. 
    2. Under no circumstances will Frontier be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the service or your account or the information contained therein.
    3. To the maximum extent permitted by applicable law, Frontier assumes no liability or responsibility for any
      1. errors, mistakes, or inaccuracies of content; 
      2. personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; 
      3. any unauthorized access to or use of our secure servers and/or any and all personal information stored therein;
      4. any interruption or cessation of transmission to or from the service;
      5. any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party; 
      6. any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service; and/or 
      7. user content or the defamatory, offensive, or illegal conduct of any third party. In no event shall Frontier Institute, its affiliates, agents, directors, employees, suppliers, or licensors be liable to you , in the aggregate, for any claims, proceedings, liabilities, obligations, damages, losses or costs in an amount exceeding the greater of (a) the amount you paid Frontier in the twelve (12) months preceding the event giving rise to the claim or (b) USD $100. Nothing in this Agreement excludes or limits liability for gross negligence, willful misconduct, fraud, death or personal injury caused by Frontier’s negligence, or any other liability that cannot be excluded or limited under applicable law .
    4. This limitation of liability section applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Frontier has been advised of the possibility of such damage. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
    5. Some states do not allow the exclusion of implied warranties or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. 
    6. This Agreement gives you specific legal rights, and you may also have other rights which vary from state to state. The disclaimers, exclusions, and limitations of liability under this Agreement will not apply to the extent prohibited by applicable law.
    7. The Service is controlled and operated from its facilities in the United States. 
    8. Frontier makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so of their own volition and are entirely responsible for compliance with all applicable United States and local laws and regulations, including but not limited to export and import regulations.
    9. The Service is offered internationally, and the availability of particular programs, courses, features, or content may vary by jurisdiction. Frontier may, in its discretion, restrict or decline to make the Service or any portion of it available in any jurisdiction. Nothing on the Service constitutes an offer or solicitation in any jurisdiction where such an offer or solicitation would be unlawful, and materials on the Service do not constitute a representation that any program is authorized, recognized, or appropriate for use in any particular jurisdiction.
  • Assignment
    1. This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by Frontier without restriction.
    2.  Any attempted transfer or assignment in violation hereof shall be null and void.
  • General
    1. Notification Procedures
      1. Frontier may provide notifications, whether such notifications are required by law or are for marketing or other business-related purposes, to you via email notice, written or hard copy notice, or through posting of such notice on our website, as determined by Frontier in our sole discretion. 
      2. Frontier reserves the right to determine the form and means of providing notifications to our Users, provided that you may opt-out of certain means of notification as described in this Agreement.

    2. Entire Agreement / Severability

This Agreement, together with any amendments and any additional agreements you may enter into with Frontier in connection with the Service, shall constitute the entire agreement between you and Frontier concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
    3. No Waiver
      1. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Frontier’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

    4. Order of Precedence
      1. These Terms of Use apply to all users of Frontier services. Certain programs, courses, certifications, academic offerings, or services may be governed by additional agreements, catalogs, student handbooks, enrollment agreements, academic regulations, or institutional policies.
      2. In the event of any conflict between these Terms of Use and a program-specific policy, enrollment agreement, student handbook, academic catalog, or other institutional policy, the more specific document shall govern with respect to the subject matter addressed therein. 
  • Governing Law
    1. These Terms of Use shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to conflict of law principles.
    2. Any dispute arising out of or relating to these Terms of Use, enrollment, participation in Frontier programs, or use of Frontier services shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, United States of America.
    3. Nothing in these Terms of Use limits any rights afforded to the learner under applicable consumer protection laws that cannot legally be waived.
